Whose Insurance Pays if a Tree Falls on Your House?

This is one of the most common questions homeowners ask after a tree comes down — and the answer is not what most people expect. The short version: in most cases, your own homeowner's insurance handles the damage to your property, regardless of whose tree it was.

  • Neighbor's tree fell on your house → still your homeowner's insurance (usually)
  • Tree fell in yard with no structural damage → likely not covered
  • Tree fell on your car → your auto insurance (comprehensive)

When it is your tree

If a tree from your property falls and damages your house, your homeowner's insurance typically covers removal from the structure and repairs, subject to your deductible. Most standard policies cover this as long as the damage was caused by a covered peril — wind, storm, lightning. The major exception: neglect. If your tree was visibly dead or diseased and you did nothing about it, your insurer may deny or reduce the claim on the grounds that you knew the tree was a hazard.

When it is your neighbor's tree

Here is where most people are surprised: even if a tree from your neighbor's yard falls on your house, it is your own homeowner's insurance that pays — not your neighbor's. Your insurer may then go after your neighbor's insurer to recover costs (a process called subrogation), but that happens on the back end. You file with your own policy and let the companies sort it out.

The exception is negligence. If the tree was visibly dead or diseased and you notified your neighbor in writing about the hazard and they did nothing, that written documentation can support a claim against their policy. Without it, proving negligence is very difficult.

When a tree falls but does not hit the house

If a tree falls in your yard without hitting a structure, most homeowner's policies will not cover removal. Coverage generally requires damage to an insured structure. A few policies include debris removal regardless of damage — but that is the exception. Check your specific policy before assuming you are covered.

What about your car?

Vehicle damage from a fallen tree is covered under comprehensive auto insurance — not your homeowner's policy. This applies regardless of whose tree it was. If you only carry liability on your vehicle, you likely have no coverage for tree damage to the car.
